Concerning UPLS : "The Patent Establishment prefers to create its own court to better control it, and avoid any judicial review from non-patent courts" declares FFII President Benjamin Henrion. As ACTA's process UPLS is also elaborated in a "Bell Jar" context. Our first impression is confirmed : one more non democratic legislation to protect some narrow private interests (as usual in the IP old world). In fact "non democratic legislation" is a weak expression that we can replace with "feudal vestige'. Don't forget the following Pr Michel Vivant quote : "Patent law do not operate in a vacuum"

There are two main ways to carry out wisely the European policy and to improve technical innovations : an open and collaborative one ( as the internet frame model or the Free Software development process ) characterized by the growth of international exchanges particularly in the knowledge sharing field or an opposite way promoted by a handful of conservative forces in other words the nineteenth century nostalgic minds. To be more precise and challenging we take the liberty to compare a Phd scientific or medicine thesis with an ordinary patent : the first one is opened to the world and in most cases an excellent ideas tank whereas the second one is like an expensive closure and in a too numerous cases a laughable innovation vector.

To protect the patentees feudal interests an useless armada of lawers is more than necessary : the global cost of a "United Patent Litigation System" is extremely high. This extravagant expenditure will be mainly covered by all the european people for the profit of some private interests; that is the last straw ! The parasitism of industrial property lawyers (as such) will be reinforced ( at least in Europe ).

The cost of past-oriented thinking will be immediately reduced if you try to follow this non expensive FFII advice : The "make polluters pay" approach (please see below the priceless Georg Jakob and Hartmut Pilch KnowRights_2010 slides URL ). An unexpected opportunity to put an end to the lack of European legislator credibility. A turning point in a way !

Agenda

Mr Gaster replied to this presentation that software patents were only representing 3% of the total patent applications.

A recent book "Patent Law for Computer Scientists" by EPO examinors says that 30% of all EPO patents (granted and pending) deals with computers:

There is no doubt after the conference that the European Commission is pushing for software patents via the caselaw of a central patent court in the EU.
